Firm Defeats State’s Motion to Dismiss in Wrongful Death Case

A Baltimore City Circuit Court Judge ruled against the State of Maryland and the Department of Juvenile Services in its attempt to have the plaintiff’s case dismissed. The plaintiffs, represented by partner Steven D. Silverman, convinced Judge Sylvester Cox that the state had both a duty to the decedent and that proper notice of the claim was provided to the state. The Court agreed. This lawsuit stems from the tragic and high-profile death of Isaiah Simmons, III, a minor, who died at the hands of employees at the now closed Bowling Brook Preparatory School in Carroll County, Maryland.
